Professional terms

1. What these terms cover

They govern professional access to Hukaia, reserved for travel agencies, advisors and organisers who compose itineraries for their clients (“the agency”). Hukaia is published by Charlotte Grude, sole trader in France (registration in progress, see the legal notice). Requesting access, then using it, means accepting these terms.

2. The trial

The trial lasts thirty days and includes fifteen itineraries, with every feature. It is free, needs no card, and stops by itself at the end: nothing is invoiced unless the agency chooses a plan. Access is opened by hand, after reading the request.

3. Plans and prices

An itinerary is the complete composition of a trip; edits to an itinerary already composed do not use a new one. Volume is counted over the last thirty days; unused volume does not carry over. Prices exclude taxes; VAT is added at the applicable rate when due. Any price change is announced by email at least thirty days before it applies, and the agency may cancel before then.

4. Invoicing and payment

Invoices are monthly, issued at the start of each month for the month beginning, payable within fifteen days by bank transfer or by the payment link shown on the invoice. Late payment automatically incurs interest at the European Central Bank refinancing rate plus ten points, and the fixed €40 recovery fee set by article L441-10 of the French Commercial Code. After a reminder left unanswered for fifteen days, access may be suspended until payment.

5. Term and cancellation

The subscription is monthly with no commitment. The agency cancels by a simple email to [email protected]: cancellation takes effect at the end of the current, already paid, month, and no further month is invoiced. Hukaia may end an access for serious breach of these terms after an unheeded warning, or with three months' notice if it stops offering the service.

6. Use of the access

An access belongs to one person: its credentials are not shared. The agency does not use Hukaia to resell the service itself, extract its content automatically, or compose for another business. It remains solely responsible for what it hands to its clients: an itinerary is a solid working basis that the agency reviews and adapts before handing it over.

7. Who owns what

Itineraries composed by the agency belong to it: it edits them, exports them and hands them to its clients under its own name, including after its subscription ends. Its name, logo and colour remain its own; it authorises Hukaia to display them on the documents and pages it sends. The software, the composition engine and the Hukaia brand remain the publisher's property.

8. Liability

Hukaia is a composition tool. It is not a travel agency, an organiser or an intermediary: it does not sell, book or guarantee any travel service, and obligations towards the traveller under travel law remain the agency's. Places and opening times are checked as far as possible at the time of composition; they may change afterwards. Hukaia undertakes to use reasonable means to provide an available and accurate service (best-efforts obligation). Its liability, if engaged, is limited to direct damage and capped at the amounts paid by the agency over the previous twelve months.

9. The agency's client data

For the personal data of the agency's clients, the agency is the controller and Hukaia acts as processor, within the meaning of article 28 of the GDPR. This section serves as the processing agreement.

Data
the name given to the client folder, the client's email address if the agency chooses to send the proposal from its workspace, and what the agency writes in its trip request.
Purposes
composing the itinerary, sending the proposal and follow-ups on behalf of the agency, telling the agency when it was opened. Nothing else: Hukaia never writes to the agency's clients in its own name and never reuses this data.
Retention
as long as the account exists; the agency deletes a folder whenever it wants. Three months after the subscription ends, client folders are erased.
Sub-processors
Supabase (database, Ireland, European Union), Cloudflare (page hosting), Resend (email delivery), Anthropic (itinerary composition from the request text). The agency is told by email before any addition, and may object by cancelling.
Security
encrypted access, per-account permissions, no client data passed on for advertising. A data breach affecting this information is notified to the agency within 48 hours of its discovery.
Rights
Hukaia helps the agency answer its clients' requests (access, correction, erasure) within a reasonable time.

10. Confidentiality

Hukaia discloses to no one the agency's files, its partner list or its commercial terms, and does not use them for other agencies.

11. Governing law

These terms are governed by French law. In case of disagreement, the parties first seek an amicable solution; failing that, the competent courts of the publisher's place of residence have sole jurisdiction.
